HR-03 - DOLE Inspection Ready: Achieving Fully Compliant Status

This course offers an in-depth understanding of the legal foundations governing DOLE inspections, including relevant labor laws and department orders. Participants will be equipped with the knowledge to identify and prepare essential compliance documents in accordance with the DOLE Inspection Checklist. The course also guides attendees in evaluating their organization’s current practices and developing actionable steps to ensure compliance before, during, and after an inspection. In addition, it highlights the penalties and serious consequences of non-compliance, while providing practical strategies to help organizations avoid common pitfalls and maintain a compliant, inspection-ready workplace.

Contents:

Module One: Legal Bases of DOLE Inspection

  • Overview of key legal foundations including Article 128 and Article 303 of the Labor Code of the Philippines.

  • Discussion of Republic Act 11058 (Occupational Safety and Health Law) and its Implementing Rules and Regulations under DOLE Department Order No. 128-18.

  • Review of relevant DOLE Department Orders, from DO 183-17 to DO 238-23, outlining specific mandates and updates related to labor inspections.

 Module Two: DOLE Inspection Process

  • Before Inspection: Preparation of required documents and materials for compliance review.

  • During Inspection: Proper conduct during the inspection, including engagement with DOLE inspectors and accurate documentation of the visit.

  • After Inspection: Procedures for submitting proof of compliance, drafting and implementing an action plan, and responding to findings through motions, appeals, or notices.

 Module Three: Penalties for Non-Compliance

  • Detailed discussion of the Table of Violations and Corresponding Penalties under both General Labor Standards (GLS) and Occupational Safety and Health (OSH) regulations.

  • Understanding the risks and consequences of non-compliance from a legal and operational standpoint.

 Module Four: Practical Application

  • Participants will assess their own company’s current level of compliance with DOLE standards.

  • Identify gaps and recommend corrective measures to address potential violations and improve overall compliance readiness.
