Module One: Understanding the Employer-Employee Relationship
Identify the existence of an employer-employee relationship using the Fourfold Test, supported by landmark jurisprudence.
Differentiate the various types of employment and employee classifications to ensure appropriate practices in hiring and termination.
Examine the exercise of management prerogatives within the bounds of good faith and fair labor practices.
Module Two: Overview of the Philippine Labor Adjudication System
Understand Republic Act 10396 and its Implementing Rules and Regulations (IRR) under DOLE Department Order No. 151-16, emphasizing conciliation-mediation as a voluntary dispute resolution mechanism.
Review performance indicators and functions of key agencies, including NLRC and SEnA.
Gain familiarity with the hierarchy of courts in labor litigation and explore relevant penalties and legal consequences based on jurisprudence.
Module Three: Proper Handling of Administrative Cases
Explore the principle of security of tenure and its implications in employment.
Learn to comply with the requirements of due process—both substantive and procedural—when handling administrative cases to ensure fairness and legal compliance.
Module Four: Practical Case Application
Participants will be provided with real-life case scenarios to analyze and present solutions.
Emphasis is placed on handling cases correctly at the administrative level to prevent escalation into full labor disputes.
